🔴Sidang Praperadilan Pegi, Polda Jabar Boyong Bukti & Ngotot Penetapan Tersangka Sah di Kasus Vina

Pernyataan itu disampaikan dalam sidang lanjutan praperadilan Pegi Setiawan.
Yakni dengan agenda mendengarkan jawaban dari Polda Jabar selaku termohon, atas gugatan tim kuasa hukum Pegi pada Selasa (2/7/2024).
Diketahui, sidang lanjutan itu dilaksanakan di Pengadilan Negeri (PN) Bandung.
Bahkan, Polda Jabar juga menekankan bahwa ada surat tugas dan surat perintah penyidikan lanjutan terkait kasus Vina.
Adapun penyidik mengeluarkan surat tugas pada (19/5/2024) dan surat perintah penyidikan lanjutan pada (27/5/2024) lalu.
Polda Jabar pun membantah seluruh dalil-dalil dalam gugatan yang disampaikan oleh tim kuasa hukum Pegi selaku pemohon.
Menurut Polda Jabar, gugatan yang disampaikan oleh termohon sudah memasuki materi pokok perkara.
Padahal, berdasarkan pasal 2 ayat 2 peraturan Mahkamah Agung (MA) RI Nomor 4 tahun 2016, tentang peninjauan terhadap permohonan tentang tidak sahnya penetapan tersangka hanya menilai aspek formil.
Yaitu apakah ada paling sedikit dua alat bukti yang sah dan tidak memasuki materi perkara.
Sehingga terhadap permohonan praperadilan adalah hanya memeriksa dan menilai aspek formal terhadap penetapan tersangka yang dilakukan oleh pemohon.
