Ketua MK Suhartoyo menegaskan hal tersebut dalam Putusan untuk Perkara Nomor 91/PUU-XXIII/2025, yang menguji materiil Pasal 128 huruf k Undang-Undang Nomor 1 Tahun 2015 tentang Pemilihan Umum Kepala Daerah.
Adapun perkara ini diajukan oleh Dewan Pimpinan Daerah Lembaga Pengawasan Reformasi Indonesia (DPD-LPRI) Kalimantan Selatan, diwakili oleh Syarifah Hayana selaku ketua. Ia mendalilkan Pasal 128 huruf k UU Pilkada yang mengatur larangan untuk dilakukan oleh lembaga pemantau bersifat multitafsir dan tidak memberikan kepastian hukum.
Permohonan itu bun dikabulkan untuk seluruhnya dnengan pertimbangan bahwa pasal a quo bertentangan dengan UUD 1945 dan tidak mempunyai kekuatan hukum mengikat.
