Tim Kennedy (D-NY) asked Secretary Markwayne Mullin about Nurul Amin Shah Alam, a refugee Border Patrol dropped at a Tim Hortons in Buffalo in February. Border Patrol had called the spot 'a warm, safe location.' Twice, Mullin answered only that the case is under investigation.
We check that statement against the record. Buffalo's mayor says the shop was closed. Surveillance video obtained by the Investigative Post shows him in jail booties in the parking lot. The Erie County Medical Examiner ruled his death a homicide, a medical term for a death that came from someone else's actions or failure to act, and CBP pointed back to the same statement. My read: 'under investigation' keeps that line standing.
