Judge William Sullivan entered the courtroom and said the jury sent in a note, which he read."With a heavy heart we are unable to come to a unanimous decision and will not be able to," Sullivan read.
Sullivan said the jury did not ask to be sent back. "I don't feel I have any choice to declare a mistrial," Sullivan said. "I'm going to declare a mistrial at this point."
Before the jury came in, Defense attorney Kevin Reddington asked for an emergency stay to file a single-justice appeal to the Supreme Judicial Court, referencing the "intractability" of a single juror.
Reddington asked for a day to file the appeal, and Sullivan gave him an hour.
