Hal itu diputuskan Mahkamah Konstitusi (MK) dalam sidang pengucapan putusan perkara Nomor 96/PUU-XXII/2024, Senin (29/9/2025).
Tapera adalah program pemerintah Indonesia yang bertujuan untuk membantu masyarakat memiliki rumah layak melalui mekanisme tabungan jangka panjang. Skema Tapera awalnya hanya untuk pegawai negeri yang dikelola pemerintah melalui Badan Pertimbangan Tabungan PNS atau Bapertarum PNS.
Tetapi dengan lahirnya UU 4/2016 dan Peraturan Pemerintah 25/2020 juncto PP 21/2024 yang diteken Presiden Jokowi pada 20 Mei 2024, seluruh pekerja dan masyarakat mandiri diikutsertakan dalam penyediaan rumah tersebut.
Ketentuan ini, mewajibkan pekerja untuk membayarkan iuran perumahan rakyat sebesar 2,5 persen dari upah dan 0,5 persen dibayarkan oleh pemberi kerja. Tapera efektif berlaku paling lambat tujuh tahun setelah penetapannya atau pada tahun 2027.
Sejumlah pihak menggugat Undang-Undang Nomor 4 Tahun 2016 tentang Tabungan Perumahan Rakyat (Tapera) ke MK.
