Menurut Hakim Konstitusi Saldi Isra, para pemohon yang terdiri dari mahasiswa dan masyarakat sipil tidak punya kedudukan hukum atau legal standing.
Mereka dianggap tidak menunjukkan upaya aktif dalam proses pembentukan UU TNI, seperti ikut seminar atau diskusi, dan hanya mengetahui proses itu dari pemberitaan media.
Selain itu, permohonan mereka juga dinilai tidak jelas karena tidak mampu menjelaskan kaitan antara dugaan pelanggaran konstitusi dengan kerugian pribadi yang dialami.
Saat ini, masih ada sembilan permohonan uji materi UU TNI yang berproses di MK. Pemohonnya beragam, mulai dari mahasiswa sejumlah universitas, advokat, koalisi masyarakat sipil, hingga perorangan.
