Menurutnya, UU ITE tidak bisa digunakan untuk mempidanakan seseorang terlebih untuk kasus ijazah palsu.
Roy memandang sudah banyak korban atas pasal-pasal karet di UU ITE.
Ia lantas mengungkit kasus Prita Mulyasari yang menjadi korban pasal karet di UU ITE.
Curhatan Prita soal keluhan pelayanan RS Omni Internasional berujung pada gugatan Pasal 27 ayat 3 UU ITE.
Pernyataan Roy Suryo turut direspons oleh Sekjen Peradi Bersatu, Ade Darmawan.
Ia menyanggah penafsiran Roy soal UU ITE tersebut.
Menurut Ade, penafsiran Undang-Undang hanya bisa dilakukan advokat, jaksa, hakim, dan polisi.
Tanpa latar belakang itu, Ade memandang Roy Suryo tak pantas untuk menafsirkan Undang-Undang.
"Dan ingat, Roy Suryo jangan lagaknya seperti advokat mampu menafsirkan undang-undang. Itu nggak boleh," ucapnya di Mapolda Metro Jaya, Jakarta, Selasa (10/6/2025).
Diketahui, Bareskrim Polri telah selesai melakukan uji laboratorium forensik (labfor) terhadap ijazah Jokowi.
Meski Bareskrim telah menyebut jika ijazah Jokowi asli, namun, sejumlah pihak masih ingin membuktikannya di persidangan.
