Pelaku yang merupakan mantan pecatan Kostrad, Budi Hartono alias BH, ternyata positif menggunakan narkoba jenis sabu dan miras saat beraksi.
Menurut keterangan Kapolres Kendal, AKBP Hendry Susanto Sianipar, Kamis (12/6/2025), pelaku diketahui menggunakan barang haram tersebut sebelum keluar dari rumah, tepatnya pukul 10.00 WIB.
Dari pemeriksaan yang dilakukan di rumah korban, polisi menemukan sejumlah barang bukti berupa satu alat isap sabu, dua botol miras hingga air soft gun.
Kapolres menambahkan bahwa motif tersangka yang mengemudikan mobil secara zig-zag hingga menabrak itu murni dari pengaruh miras.
Terkini diketahui bahwa polisi masih melakukan penyelidikan lanjutan terkait asal mula sabu yang digunakan pelaku.
Atas perbuatannya, pelaku dikenakan pasal berlapis.
Ia dijerat pasal 2 ayat 1 UU Darurat Nomor 12 Tahun 1951 Jo UU RI Nomor 1 Tahun 1961, tentang Penetapan Semua UU Darurat, dengan ancaman pidana penjara selama 10 tahun.
Kemudian BH juga dikenakan pasal 213 KUHP dengan ancaman hukuman penjara selama lima tahun.
Tak hanya itu ia juga dijerat pasal 112 ayat 1 subsider 127 ayat 1, dengan pidana penjara empat tahun dan maksimal seumur hidup, serta denda senilai Rp 800 juta.
Sementara itu pada pasal 127, pelaku terkena ancaman pidana penjara selama empat tahun.
