Il testo era già stato bocciato il 26 marzo con 311 voti contrari, 228 favorevoli e 92 astenuti, e la deroga era scaduta il 3 aprile. Il 2 luglio il Consiglio UE ha ripresentato un testo pressoché identico sotto forma di nuovo regolamento, e la presidente Roberta #Metsola ha riaperto il dossier in seconda lettura, una procedura che ribalta i rapporti di forza: per respingere la posizione del Consiglio non basta la maggioranza dei presenti in aula, ma serve la maggioranza assoluta di tutto il Parlamento, 361 voti su 720.
