I giudici della seconda sezione penale della Corte d'appello di Brescia, presieduti da Antonio Minervini, sono chiamati a decidere se confermare la sentenza di condanna oppure dare il via a un nuovo processo, ammettendo le nuove prove presentate dalla difesa (avvocati Fabio Schembri, Nico D'Ascola, Luisa Bordeaux e Patrizia Morello) dei due coniugi condannati in via definitiva all'ergastolo per l'eccidio dell'11 dicembre 2006 a Erba, in provincia di Como.
