Pengamat Soal Putusan MK 135: Hukum Pemilu Terus Berkembang
Putusan Mahkamah Konstitusi (MK) Nomor 135/PUU-XXII/2024 telah mengubah arah desain demokrasi elektoral Indonesia.Pemilu nasional yang meliputi pemilihan presiden, DPR, dan DPD akan tetap dilangsungkan serentak pada tahun 2029, sedangkan Pilkada serentak berpotensi digelar pada 2031.
Menanggapi putusan MK, Titi Anggraini, pengamat pemilu, mengatakan dinamika hukum kepemiluan Indonesia terus berkembang dari masa ke masa.
Termasuk juga berkaitan dengan tafsir konstitusional dari Mahkamah Konstitusi berhubungan dengan pengaturan pemilu.
Titi mencontohkan, Pasal 22E Ayat 2 UUD 1945 telah mengalami perubahan konstruksi dari waktu ke waktu, termasuk perubahan dari pilpres terpisah menjadi pemilu serentak.
Selain itu, MK telah mengeluarkan beberapa putusan yang mempengaruhi desain pemilu, termasuk Putusan MK Nomor 14 tahun 2013 dan Putusan MK Nomor 55 tahun 2019.
Menurutnya, putusan MK Nomor 135 menimbulkan pertanyaan tentang regularitas pemilu 5 tahun sekali dan desain keserentakan pemilu nasional dan daerah.
