🔴 La Unión Europea ha adoptado una decisión sin precedentes al congelar de forma indefinida activos rusos mediante una cláusula de emergencia diseñada para crisis económicas internas, desplazando en la práctica la regla de la unanimidad en política exterior sin reformar los Tratados. El hecho no es un tecnicismo jurídico, sino un cambio material en el modo en que se decide el poder en Europa: la excepción se ha impuesto a la norma y la decisión ha prevalecido sobre el procedimiento, alterando el equilibrio institucional entre Estados, Comisión y Parlamento.
🔴 Desde una lectura schmittiana, este episodio revela dónde reside hoy la soberanía real en la UE y cómo se ejerce cuando el marco jurídico estorba a los objetivos estratégicos. La neutralización del veto, la irreversibilidad práctica de la medida y la marginación del debate constituyente dibujan un golpe blando, jurídico e institucional, que transforma la arquitectura europea sin declararlo abiertamente y normaliza la gestión por excepción en un contexto de crisis permanente.
