BGH zieht Grenze: Wann das Sozialamt geschenktes Geld nicht mehr zurückholen darf | VertraulichDer Bundesgerichtshof hat ein wichtiges Urteil zur Rückforderung von Schenkungen durch das Sozialamt gefällt. Entscheidend ist dabei die Unterscheidung zwischen Geldgeschenken und Immobilien: Während bei Geldgeschenken an Kinder eine Verjährungsfrist von drei Jahren ab dem Zeitpunkt gilt, an dem der Schenkende von seiner Bedürftigkeit weiß, können Immobilien unter bestimmten Voraussetzungen bis zu zehn Jahre lang zurückgefordert werden.
