E mentre il governo insiste su una lettura più “flessibile” delle regole, la #giurisprudenza sembra tracciare un confine netto: senza #omologazione, la multa non vale.
Uno dei nodi principali è la differenza tra approvazione e omologazione dell’autovelox. Per il #governo, le due fasi si equivalgono, tanto che negli anni si è proceduto spesso con la sola approvazione dei dispositivi. Ma la giurisprudenza della Cassazione è di ben altro avviso. “Non è possibile fare questo tipo di equiparazione”, ha affermato Giuseppe Di Palo. “L’omologazione è una verifica più stringente, necessaria perché la contravvenzione possa essere considerata valida.” Senza questo passaggio tecnico, dunque, il verbale rischia di essere nullo.
