Gugatan ini dilayangkan oleh seorang adokat bernama Haji Muhammad Subhan Palal dengan nilai tuntutan mencapai Rp 125 Triliun.
Hingga pukul 10.00 WIB, penggugat Subhan sudah hadir di lokasi namun pihak tergugat Gibran maupun perwakilan KPU belum tampak.
Dalam petitumnya, Subhan meminta majelis hakim untuk:
1. Menghukum Gibran dan KPU secara tanggung renteng membayar ganti rugi materiil dan immateriil sebesar Rp 125 triliun yang disetorkan ke kas negara.
2. Membayar uang paksa (dwangsom) Rp 100 juta per hari jika lalai melaksanakan putusan pengadilan.
3. Menanggung biaya perkara secara tanggung renteng.
Menurut Subhan, kerugian negara itu nantinya akan dibagi rata untuk seluruh warga Indonesia.
Subhan menilai pencalonan Gibran sebagai wapres pada Pemilu 2024 cacat hukum karena tidak memenuhi syarat pendidikan minimal SMA atau sederajat.
Ia menegaskan bahwa pendidikan Gibran di Orchid Park Secondary School, Singapura dan UTS Insearch Sydney, Australia tidak dapat disetarakan dengan ijazah SMA di Indonesia.
“Ini murni masalah hukum. Apakah KPU boleh menafsirkan pendidikan luar negeri setara dengan SMA di dalam negeri? UU Pemilu jelas hanya menyebut SLTA atau sederajat,” kata Subhan.
Ia pun menegaskan gugatannya bukan karena motif politik.
Subhan mengaku mengajukan gugatan atas inisiatif pribadi.
