Penyidik Polda Jawa Barat diminta tak usah memaksakan untuk memunculkan bukti baru guna kembali menjerat Pegi Setiawan sebagai tersangka pasca putusan sidang praperadilan di Pengadilan Negeri Bandung.
Ahli Hukum Pidana dari Universitas Bina Nusantara (Binus) Ahmad Sofian mengatakan, meski dalam Peraturan Mahkamah Agung (Perma) Nomor 4 Tahun 2016 penyidik diperbolehkan menetapkan seseorang menjadi tersangka lagi sepanjang ada bukti baru, namun ia meminta hal itu tak perlu dipaksakan.
Pasalnya, nantinya bukan tidak mungkin kubu Pegi Setiawan kembali mengajukan praperadilan untuk membuktikan keabsahan jika Pegi kembali ditetapkan sebagai tersangka.
Adapun menurut Sofian yang perlu dilakukan oleh pihak kepolisian setelah adanya putusan Hakim Praperadilan yaitu mengeluarkan Surat Perintah Penghentian Penyidikan atau SP3.
Lantaran dalam kasus ini penting dikeluarkannya SP3 karena sebelumnya hakim telah memutuskan bahwa penetapan tersangka terhadap Pegi tidaklah sah.
Lebih jauh walaupun kata Sofian penetapan Pegi kembali sebagai tersangka belumlah tertutup sepenuhnya, namun hal itu bakal menjadi sulit bagi pihak penyidik.
Salah satu hal yang akan mempersulit penyidik yakni untuk membuktikan adanya alat bukti dalam kasus pembunuhan Vina yang sudah terjadi cukup lama.
