La polemica nasce da una telefonata tra il procuratore di Napoli Nicola Gratteri e una giornalista de Il Foglio, diretto da Claudio Cerasa. Il quotidiano racconta che, irritato per alcune ricostruzioni sul referendum sulla giustizia, il magistrato avrebbe detto: «Dopo il referendum con voi del Foglio faremo i conti», frase che scatena immediatamente polemiche politiche e mediatiche. Gratteri replica spiegando che potrebbe valutare una querela contro chi ritiene abbia diffamato la sua posizione e precisando di sapere bene «cosa significa essere bersaglio di minacce». Il caso arriva anche in tv a Piazzapulita, dove lo scrittore ed ex magistrato Gianrico Carofiglio commenta la vicenda.
