Il caso nasce da uno dei cosiddetti processi pilota, utilizzati per aprire nuovi scenari giuridici, come avvenne negli anni ’90 con le cause contro il tabacco. Protagonista è Kaley, oggi ventenne, che ha denunciato Instagram, YouTube, TikTok e Snapchat sostenendo di essere stata agganciata dalle piattaforme, con conseguenze psicologiche gravi fino a pensieri suicidari. Il tribunale le ha riconosciuto un risarcimento di 6 milioni di dollari, aprendo la strada a oltre 10.000 possibili cause simili.
Il punto centrale della sentenza non è la dipendenza in sé, ma il design delle piattaforme: algoritmi e meccanismi come lo scrolling continuo sono stati considerati parte di un 'prodotto difettoso', progettato in modo da creare danno. Un principio che, se arrivasse anche in #Europa, potrebbe cambiare radicalmente il rapporto tra utenti e social media, aumentando la consapevolezza sui rischi dell’esposizione digitale.
