Lindsay Clancy trial: Jury sent home, defense pushes for juror removal

The jury in the Lindsay Clancy trial was excused for the day after failing to reach a verdict on the sixth day of deliberations.

The judge asked them to return on Friday to continue deliberating.

Clancy’s attorney also requested to remove a juror on Thursday, but the judge denied that motion.

Defense attorney Kevin Reddington told the court that the jury foreperson had reported "there's one juror who refuses to listen to the law" on reasonable doubt. Reddington argued the judge's earlier instruction did not go far enough and asked him to remove the juror.

“I don’t feel that it is proper for me to side with one side or the other of the deliberations,” judge William Sullivan said in court. “I don’t feel it’s appropriate for me to say I agree with one juror or 11.”

"If we come back here in a half an hour with a mistrial because of a juror that has just spurned the instructions of this court, it's a shame," he said, moving to strike the juror.

Jurors are deciding whether Clancy was criminally responsible for killing her three children, or whether, as the defense argues, she was suffering from postpartum psychosis.
