Pegi Disebut Bisa Kembali Jadi Tersangka Jika Penyidik Polda Jabar Punya Alat Bukti Baru Kasus Vina

Hal itu disampaikan oleh pakar hukum pidana Ahmad Sofian pada Selasa (9/7).
Sofian mengatakan Pegi bisa kembali jadi tersangka jika penyidik memiliki alat bukti baru.
Alat bukti tersebut harus berbeda dengan yang sebelumnya diajukan.
Sofian menyebut hal itu tertera dalam Peraturan Mahkamah Agung Nomor 4 Tahun 2016.
"Penyidik bisa kembali menetapkan yang bersangkutan sebagai tersangka sepanjang ada alat bukti baru yang diajukan yang berbeda dengan alat bukti sebelumnya," kata Sofian.
Meski begitu Sofian tak begitu yakin jika penyidik Polda Jabar punya alat bukti baru untuk menetapkan kembali Pegi sebagai tersangka.
Pasalnya untuk mencari alat bukti baru dalam sebuah kasus yang sudah terjadi cukup lama bukan hal yang mudah.
Selain itu dalam sidang praperadilan di Pengadilan Negeri Bandung menyatakan bahwa alat bukti Polda Jabar tidak cukup untuk menetapkan Pegi sebagai tersangka.
"Jadi saya agak pesimis juga jika Pegi ditetapkan kembali sebagai tersangka karena alat bukti yang ada saja dianggap tidak cukup oleh hakim sehingga tidak sah," ujarnya. (Tribun-Video.com)
