Proposta legge FdI su Stop atto dovuto, Bignami: Inaccettabile indagare agenti che fanno loro dovere
(Agenzia Vista) L’articolo 1 della presente proposta di legge intende modificare l’articolo 335 del Codice di procedura penale, prevedendo che, in tutti i casi in cui sia ravvisabile una causa di giustificazione relativa alla notitia criminis pervenuta al pubblico ministero, questi debba procedere, entro il termine perentorio di sette giorni, ad accertamenti preliminari, al fine di valutare l’antigiuridicità o la legittimità della condotta e di evitare, se non strettamente necessaria, l’iscrizione nel registro degli indagati". E' quanto dispone il provvedimento, presentato da Fratelli d'Italia durante una conferenza stampa alla Camera. Il testo, d'iniziativa dei deputati di FdI Galeazzo Bignami, Giovanni Maiorano, Fabio Rampelli, Carolina Varchi ed Antonio Baldelli, sottolinea che "i recenti fatti di cronaca, ad esempio, relativi all’iscrizione nel registro degli indagati per 'omicidio colposo a seguito di eccesso colposo nell’uso legittimo delle armi' dei due agenti che hanno risposto al fuoco e neutralizzato l’aggressore del brigadiere Carlo Legrottaglie, rimasto ucciso, hanno evidenziato una falla nell’attuale sistema, come disciplinato dal Codice di procedura penale".
