Pernyataan itu ia sampaikan saat ditemui awak media di Pengadilan Tipikor Jakarta Pusat, Selasa (15/7/2025).
Menurutnya, kegiatan importasi gula yang dilakukan Tom Lembong sudah mendapat izin dari Jaksa Agung HM Prasetyo dan Jaksa Agung Muda Bidang Tata Usaha Negara (Jamdatun) pada 2017.
Izin itu diberikan Jaksa Agung dan Jamdatun setelah dimintai pendapat hukum oleh Menteri Perdagangan (Mendag) saat itu, Enggartiasto Lukita.
Diketahui bahwa Enggar sendiri merupakan Mendag yang meneruskan kebijakan impor gula kristal setelah Tom Lembong.
Aktivitas impor gula mentah itu dilakukan untuk memenuhi kebutuhan gula dalam negeri.
Atas dasar itu kemudian Hotman mengklaim bahwa Tom Lembong seharusnya bisa dibebaskan atas hukumannya.
Diketahui sebelumnya, Tom Lembong dituding terlibat dalam kasus dugaan korupsi impor gula yang merugikan keuangan negara senilai Rp 578 miliar.
Ia kemudian dituntut Jaksa dengan hukuman kurungan penjara selama tujuh tahun dan denda Rp 750 juta, subsider 6 bulan kurungan.
Namun Tom dan kuasa hukumnya membantah tuntutan jaksa dengan mengklaim tindakan itu sebagai aksi politis.
Mereka juga menilai bahwa kasus tersebut berseberangan dengan penguasa pada Pilpres 2024 kemarin.
