▷ AIUTA L'INFORMAZIONE LIBERA, SOSTIENICI: https://donazioni.radioradio.it/Il 28 luglio 1976, esattamente cinquant'anni fa, la Corte Costituzionale mise fine — almeno in ambito locale — al monopolio RAI sulle trasmissioni radiotelevisive con la storica sentenza n. 202. La pronuncia arrivò dopo anni di ricorsi di pretori e tribunali di tutta Italia e aprì la strada alla nascita delle prime radio e tv private, in un contesto normativo che fino ad allora prevedeva conseguenze anche penali per chi trasmetteva senza autorizzazione statale.
Non fu però la prima volta che la Consulta si occupò della questione: già nel 1960 due emittenti, tra cui una legata al quotidiano Tempo, avevano chiesto la concessione per trasmettere, senza successo. All'epoca la giustificazione giuridica del monopolio pubblico poggiava sull'idea che le frequenze disponibili fossero insufficienti a garantire il pluralismo a tutti gli operatori.
Ne discute l'avvocato Gian Luca Barneschi, che ricostruisce la vicenda giuridica dell'epoca e sottolinea come, secondo la Consulta del 1960, "il monopolio garantiva il pluralismo più di un presunto oligopolio" — una tesi che, spiega, reggeva sul piano giuridico ma non su quello tecnico, visto che lo spazio in FM e sui canali televisivi in realtà c'era già.
