Dalam sidang tersebut, Menteri Pertahanan Sjafrie Sjamsoeddin dan Menteri Hukum Supratman Andi Agtas hadir secara langsung mewakili pemerintah.
Mereka turut didampingi oleh wakilnya masing-masing.
Selain mendengarkan keterangan resmi dari pihak pemerintah, sidang kali ini juga beragendakan mendengarkan keterangan dari DPR terhadap lima perkara uji formil dan materill atas UU TNI.
Dalam sidang, Menteri Hukum Supratman Andi Agtas menilai para pemohon dalam perkara pengujian UU TNI tidak memiliki kedudukan hukum atau legal standing yang memadai.
Selain itu, para pemohon disebutnya bukan pula pegawai di instansi sipil yang berpotensi dirugikan dengan diperluasnya kesempatan militer untuk menduduki jabatan sipil.
Senada, Ketua Komisi I DPR RI Utut Adianto menyebut pemohon uji UU TNI tidak punya kapasitas karena tidak berkapasitas sebagai TNI, calon prajurit TNI, ataupun pegawai di instansi sipil.
