Tra le proposte allo studio per la riforma del Codice della Strada e l'ipotesi di una patente digitale a punti per l'accesso dei minori di 16 anni ai #socialnetwork, si fa strada un sistema che richiama, per meccanismo e finalità, i crediti sociali già in vigore in #Cina. Ai microfoni di Fabio Duranti, Carlo Iannello, docente di diritto costituzionale all'Università Luigi Vanvitelli riporta al centro un tema che attraversa la storia costituzionale italiana: il confine tra la tutela di un presunto interesse collettivo e la salvaguardia delle libertà individuali.

Il meccanismo del #patentino digitale, con la perdita di punti in caso di comportamenti sanzionati, configura secondo Iannello "un prodromo" di una più ampia regressione delle libertà. Il costituzionalista la ricollega a una logica comune a tutti i regimi totalitari, per cui "c'è la prevalenza di un supposto interesse collettivo sulla persona, sull'individuo, sulla persona umana, sul singolo". Non si tratta, precisa, di un fenomeno isolato, ma di un humus culturale che accomuna esperienze storiche diverse, "dittatoriali-trattino-totalitari", le cui differenze restano "sfumate" rispetto al principio di fondo che le accomuna. A stabilire chi sia "un bravo cittadino", osserva Iannello, resta sempre "il detentore del potere": è lui a definire cosa sia bene comune e a condizionare di conseguenza l'accesso alle libertà individuali, dall'uso di una piattaforma digitale a "quello che tu ritieni giusto fare per te".
