Avrebbe invece rinunciato al solo ministerium, cioè all'esercizio del papato e non alla condizione di papa, cioè il munus petrinum. Da allora molti sono stati gli aggiornamenti riportati dall'autore dell'inchiesta, tra cui un'istanza depositata presso il tribunale vaticano per il riconoscimento della nullità di suddetta abdicazione. Seguendo la teoria del Codice Ratzinger, Bergoglio non sarebbe stato il vero papa. Con l'arrivo a maggio di un nuovo pontefice, Leone XIV, la questione sulla legittimità si riapre. "Non ho la certezza totale che lui sia un papa legittimo perché tutti sanno, diciamo questa è la versione ufficiale, che è stato eletto da tutti e 133 i cardinali, compresi 108 falsi cardinali nominati da Francesco".
