Non avendo raggiunto la maggioranza di due terzi del Parlamento, la riforma passa nelle mani dei cittadini. Si terrà probabilmente in primavera e non avrà bisogno del raggiungimento di un quorum. "Spero in un referendum non politicizzato, sarebbe catastrofico per l'ANM", ha commentato il ministro della Giustizia Carlo Nordio dopo il sì del Senato. Le critiche arrivano dalle opposizioni e dall'Associazione Nazionale Magistrati, in particolare sulla separazione delle carriere, una delle riforme che si pone l'obiettivo di distinguere i percorsi tra giudici e pubblici ministeri. Per ridurre le influenze delle correnti, si propone poi l'istituzione di due Consigli Superiori della Magistratura, uno per i PM, l'altro per i giudici. Proprio il presidente dell'ANM, Carlo Parodi ha dichiarato in un'intervista al Corriere della Sera: "Se al referendum Nordio vincerà il sì, considerare le dimissioni da presidente ANM è doveroso". "Nessun magistrato di buon senso - ha detto Nordio di recente al Corriere della Sera - può pensare che si sia attentato all'indipendenza. Perché nella legge costituzionale questo principio è consacrato a chiare lettere. Capisco che i vertici dell'Anm siano contrari: nessun tacchino si candida al pranzo di Natale. Ma nella riservatezza molti confessano di essere favorevoli al sorteggio, che li svincola dall'ipoteca delle correnti". E' il tema che anche Alberto Contri considera centrale. Il docente di Comunicazione dice in diretta ai nostri microfoni che "è la cosa che dà più fastidio ai magistrati, il sorteggio. Vuol dire che le loro correnti vanno a sbattere contro un muro, non ne possono più fare, perché sorteggiandole possono venire eletti questi, possono venire eletti quegli altri dentro il Consiglio Superiore della Magistratura".
