LA NUOVA LEGGE ELETTORALE SPIEGATA FACILE CON IL PROF DI DIRITTO

È un sistema proporzionale con un premio di maggioranza di 70 deputati e 35 senatori per la coalizione che supera il 42% dei voti, e prende il posto del Rosatellum, in vigore dal 2017. La legge è stata promulgata dal Quirinale e pubblicata in Gazzetta Ufficiale il 9 ottobre, ma è già nel mirino della Rete per un voto libero e uguale. Il 26 ottobre la Rete depositerà trenta ricorsi nei distretti di corte d’appello per portare la legge davanti alla Corte costituzionale. I punti contestati sono sei, dal premio di maggioranza all’obbligo di indicare il candidato premier.

Eppure una buona legge dovrebbe essere “equa, una legge alla quale i cittadini si abituano, così capiscono come votare”. Il costituzionalista Carlo Iannello concorda: “Le leggi elettorali dovrebbero essere stabili, e la stabilità della legge elettorale è coerente con la stabilità del sistema politico. Dal ‘48 ai primi anni Novanta abbiamo avuto una sola legge elettorale, quasi mezzo secolo di storia repubblicana con una sostanziale stabilità, che poi è stata mistificata. Quella stabilità non l’abbiamo più avuta proprio con le leggi create per garantirla. Chi ha riformato il sistema elettorale si è comportato da apprendista stregone, e anche da furbacchione, perché la legge si cambia per battere l’avversario. Non è un bell’atteggiamento: la legge elettorale dovrebbe garantire una competizione ad armi pari tra tutte le forze politiche in campo. Per questo è sempre stato sbagliato cambiarla poco prima del voto. Lascia il dubbio, che in realtà è una certezza, che chi l’ha cambiata lo abbia fatto per il proprio tornaconto”.
