In particolare delle norme che hanno aumentato le pene per i reati di lieve identità che hanno a che fare con gli stupefacenti. Perché aumentando le pene è diventato impossibile accedere alle pene alternative. Quindi si può dire che c'è una relazione diretta tra l'attuazione del decreto Caivano e il sovraffollamento degli istituti carcerari.
