Hal itu disampaikan oleh Biro Hukum dan Humas Mahkamah Agung, Rizkiansyah, saat dihadirkan sebagai pihak terkait dalam sidang lanjutan uji materi Undang-Undang Kejaksaan di Mahkamah Konstitusi, Jakarta, hari ini, Selasa (15/7/2025).
Pasal 8 ayat 5 menyatakan bahwa tindakan hukum seperti pemanggilan, pemeriksaan, penangkapan, dan penahanan terhadap jaksa hanya dapat dilakukan atas izin Jaksa Agung dalam rangka pelaksanaan tugas dan wewenangnya.
Namun menurut Mahkamah Agung, ketentuan ini berisiko menimbulkan perlakuan istimewa bagi jaksa, apalagi jika tidak dibedakan secara tegas antara tindakan resmi dalam kapasitas jabatan dan tindakan pribadi. Dalam persidangan, Mahkamah Agung mengusulkan tiga batasan utama terhadap perlindungan hukum bagi jaksa.
