Questa volta, però, Fauci ha scelto la linea del silenzio: si è appellato al Quinto Emendamento più di cento volte, rifiutandosi sistematicamente di rispondere alle domande dei senatori repubblicani.
A rendere memorabile la seduta è stato soprattutto il faccia a faccia con il senatore dell'Ohio Bernie #Moreno, che ha aperto il suo intervento ricordando l'episodio di una madre ammanettata e arrestata a una partita di football di una scuola media per non aver indossato la mascherina. È stato proprio quell'episodio, ha raccontato Moreno, a convincerlo a lasciare le proprie attività imprenditoriali e a candidarsi al Senato. "Chi diavolo pensavi di essere per fare questo?". ha chiesto a Fauci, definendo la sua eredità di oltre cinquant'anni di servizio pubblico ormai compromessa da "una disgrazia totale e completa".
Il senatore ha poi chiesto direttamente delle scuse, invitando chi in aula si era opposto a distanziamento, obbligo di mascherina e vaccino ad alzarsi in piedi, e sollecitando Fauci a voltarsi verso di loro. Fauci non lo ha fatto, richiamandosi ancora una volta al Quinto Emendamento. Il momento più simbolico è arrivato quando un assistente di Moreno ha consegnato allo scienziato una copia tascabile della Costituzione americana, ritirata per suo conto da uno dei suoi legali.
