ศุภชัย ชี้แจง ที่ดินเขากระโดง รฟท.ไม่มีเอกสารสิทธ?
จากการที่รถไฟแห่งประเทศไทยยื่นฟ้องผู้ถือกรรมสิทธิ์ ที่ดินดังกล่าวทั้งหมด 5,083 ไร่ คำพิพากษาศาลฎีกาและศาลยุติธรรมก่อนหน้านี้แพ้คดีไป 35 ราย ไม่มีผลผูกพันกับผู้ถือกรรมสิทธิ์ น.ส.3 แปลงอื่นๆอีก 995 ราย เนื่องจากรายอื่นมีการออกเอกสารโดยหน่วยงานราชการอยู่แล้วคือ กรมที่ดิน นอกจากนี้ ในส่วนของคำวินิจฉัยศาลปกครองกลางที่เคยสั่งให้กรมที่ดินดำเนินการตามประมวลกฎหมายที่ดิน มาตรา 61 นั้น ทางคณะกรรมการตรวจสอบของกรมที่ดินได้พิจารณาข้อเท็จจริงแล้วพบว่า รฟท. ไม่สามารถนำเอกสารแผนที่มายืนยันเขตที่ดินของตนเองได้ กรมที่ดินจึงไม่มีเหตุผลที่จะไปยกเลิกโฉนด ฝ่ายกฎหมายพรรคภูมิใจไทย ชี้แจงว่า ในความเป็นจริงไม่เคยมีข้อเท็จจริงหรือเอกสารใดระบุว่าที่ดินตรงนั้นมีการหวงห้าม และการได้มาซึ่งที่ดินของรัฐต้องมาโดยผลของกฎหมาย เช่น การซื้อขาย การเวนคืน หรือการโอนกันระหว่างหน่วยงานราชการ แต่ รฟท. กลับไม่มีเอกสารสิทธิ์ใด ๆ มายืนยัน มีเพียง ส.ค.1 หรือแผนที่ภายในของ รฟท. เท่านั้น ซึ่งที่ผ่านมาเวลาประชาชนไปยื่นขอออกโฉนด รฟท. ก็มาร่วมชี้แนวเขตและรับรู้โดยตลอด ไม่เคยมีการคัดค้านแต่อย่างใด#ศุภชัย #เขากระโดง #กรมที่ดิน #การรถไฟแห่งประเทศไทย #พรรคภูมิใจไทย #วิสาหกิจชุมชน เรื่องข่าวเรื่องใหญ่ #PPTVHD36
