È su questo punto che si apre una questione giuridica e costituzionale ancora oggi irrisolta: cosa accade quando il presupposto fattuale su cui si fonda una legge si rivela falso?
Nel caso dell’obbligo vaccinale introdotto durante la pandemia da #Covid-19, il presupposto dichiarato dal legislatore era chiaro: la vaccinazione avrebbe prevenuto la diffusione del contagio da SARS-CoV-2. Su questa base si è giustificato un obbligo particolarmente incisivo, inizialmente per i sanitari e poi progressivamente esteso a larghe fasce della popolazione, con sanzioni che arrivavano alla sospensione dal lavoro.
Tuttavia, già nel corso del 2021 e poi in modo sempre più esplicito nel 2022, è emerso un dato che oggi è pacifico e riconosciuto anche dalle autorità regolatorie come AIFA ed EMA: i vaccini non impedivano la trasmissione del virus. Il vaccinato poteva contagiarsi e contagiare.
A questo punto la domanda diventa inevitabile: se la legge impone un trattamento sanitario per “prevenire la diffusione del contagio”, e se tale effetto non si verifica, l’impianto normativo non dovrebbe crollare?
