PLO | Nữ tài xế gây tai nạn khiến 2 mẹ con tử vong ở Vũng Tàu có thể phải đối diện mức phạt nào?Vụ việc nữ tài xế gây tai nạn giao thông trên đường Nguyễn Văn Trỗi (Phường 4, TP Vũng Tàu) hiện đang được nhiều người quan tâm. Theo thông tin, vụ tai nạn do tài xế Trần Thị Thu Th (37 tuổi) điều khiển ô tô va chạm 4 xe máy khiến 2 người tử vong, nhiều người bị thương. Kết quả đo nồng độ cồn của Trần Thị Thu Th lần thứ nhất là 0,385 mg/L, lần thứ hai là 0,503 mg/L. Công an TP. Vũng Tàu đã lập biên bản bắt người phạm tội quả tang, củng cố hồ sơ khởi tố vụ án, khởi tố bị can đối với Th.
Vấn đề pháp lý được nhiều người quan tâm là tài xế này có thể phải đối diện với mức phạt ra sao? Trao đổi với PLO, Luật sư Võ Đan Mạch, Đoàn Luật sư TP.HCM cho biết trước hết, tài xế điều khiển xe ô tô tham gia giao thông đường bộ mà trong hơi thở có nồng độ cồn vượt quá 0,4 miligam/1 lít khí thở là vi phạm quy định tại khoản 8 Điều 8 Luật Giao thông đường bộ năm 2008, điểm a khoản 10 Điều 5 Nghị định 100/2019. “Trong vụ việc này, tài xế tham gia giao thông đường bộ mà vi phạm quy định về nồng độ cồn, gây hậu quả làm chết 2 người thì có thể bị truy cứu trách nhiệm hình sự về tội "Vi phạm quy định về tham gia giao thông đường bộ" theo điểm đ khoản 2 Điều 260 Bộ luật Hình sự năm 2015 (sửa đổi, bổ sung năm 2017). Tài xế này có thể đối diện với mức phạt tù từ 3 - 10 năm; bị cấm đảm nhiệm chức vụ, cấm hành nghề hoặc làm công việc nhất định từ 1 năm đến 5 năm (khoản 5 Điều 260 BLHS)”- Luật sư Mạch cho hay.
