Lindsay Clancy returns to court and attorney Kevin Reddington asks judge, 'where is the evidence?'
Weeks after the Lindsay Clancy trial ended in a mistrial, she returned to a court for a hearing Tuesday. Her defense attorney, Kevin Reddington argued that the prosecution failed to prove criminal responsibility beyond a reasonable doubt in the case and argued in a motion for a required finding that Lindsay Clancy is not guilty.He said that the issue goes back to his earlier attempt to bifurcate the case, asking the court to try the issue of criminal responsibility separately from the performance of the act. Reddington argued lay persons have difficulty getting beyond the fact that Clancy acknowledged killing her children.
The prosecution has to prove criminal responsibility beyond a reasonable doubt, Reddington said, citing a "total and complete lack of evidence to indicate to a rational juror" that Clancy was guilty.
"Where's the evidence that she did this?" Reddington said.
"The evidence shows a nurse a mother, a friend, who did nothing wrong in her life," Reddington said. Why would she kill those three children? All six of the doctors indicated she was suffering a mental disease or defect."
