Dopo tre anni di trattative l’Unione Europea è vicina a varare il nuovo codice dei medicinali, la riforma più importante del settore degli ultimi vent’anni. I governi dei Ventisette, riuniti nel Consiglio UE, hanno dato il via libera il 28 settembre. Manca solo il sì definitivo del Parlamento Europeo, atteso in aula il 25 novembre. A quel punto le nuove norme varranno per tutti gli Stati membri, Italia compresa.
A Roma intanto la commissione d’inchiesta parlamentare sul Covid prosegue le audizioni, e la coincidenza non è casuale per l’avvocata Renate Holzeisen. L’inchiesta serve “proprio per evitare che si ripetano errori che sono costati la vita e la salute a tanti cittadini, oltre a creare enormi danni economici”. Nel frattempo “a livello dell’Unione Europea si procede a pieno ritmo”. È lì che bisogna guardare, perché “il diritto sanitario, e in particolare quello sui medicinali, ormai è tutto eurounionale. Si decide a Bruxelles, tra Parlamento Europeo e Consiglio dell’Unione Europea, e gli Stati membri hanno poi l’obbligo di recepirlo”.
Ma cosa verrà cambiato?
La riforma si compone di due testi. Una direttiva istituisce il nuovo codice dell’Unione per i medicinali a uso umano e sostituisce la direttiva 2001/83/CE, in vigore da un quarto di secolo. Un regolamento ridisegna le procedure di autorizzazione, la sorveglianza sui farmaci e il funzionamento dell’EMA, l’Agenzia europea per i medicinali. In più di mille pagine c’è un passaggio che a molti è sfuggito.
