Bahkan TNI sedang mengkaji dugaan tindak pidana lain yang dinilai lebih serius.
Hal itu disampaikan seusai berbagai pihak menyebut institusi tak bisa melaporkan individu dengan dugaan pencemaran nama baik.
Dikutip dari Kompas.com, Kapuspen TNI, Brigjen TNI (Mar) Freddy Ardianzah buka suara pada Kamis (11/9).
Ia mengatakan hasil patroli siber menemukan indikasi adanya dugaan pelanggaran hukum lain dari Ferry Irwandi.
“Namun, kami menemukan indikasi tindak pidana lain yang sifatnya lebih serius,” kata Freddy
Freddy menyebut temuan itu masih dibahas secara internal guna menyusun konstruksi hukum yang tepat.
Pihaknya menegaskan bahwa TNI berpegang pada prinsip taat hukum dan menghormati kebebasan berekspresi warga negara.
Namun Freddy mengingatkan semua pihak agar kebebasan berpendakan itu tidak dijadikan alasan untuk menyebarkan fitnah atau disinformasi.
Di satu sisi, Menko Bidang Hukum, HAM, Imigrasi, dan Pemasyarakatan Yusril Ihza Mahendra meminta TNI berdialog dengan Ferry Irwandi dibanding mengupayakan pidana.
Yusril mengatakan langkah pidana sebagai jalan terakhir jika dialog benar-benar menemui jalan buntu.
Ia juga menilai kritik yang dilontarkan Ferry Irwandi perlu dilihat secara utuh.
Jika sifatnya konstruktif, hal itu merupakan bagian dari kebebasan berpendapat yang dijamin konstitusi.
