Kuasa hukum Tom Lembong, Zaid Mushafi mengatakan bahwa kondisi kliennya dalam kondisi sehat dan siap mendengarkan tuntutan jaksa atas dugaan korupsi impor gula di Kementerian Perdagangan periode 2015-2016.
Pada persidangan hari ini jaksa akan memaparkan kesimpulan mereka terhadap bukti-bukti dugaan korupsi importasi gula yang telah dibawa di muka hakim. Dalam kasus ini, Tom Lembong didakwa telah merugikan negara Rp578 miliar dan memperkaya 10 orang yang berafiliasi dengan perusahaan yang ditunjuknya menjadi distributor gula.
Jaksa menerangkan Tom menyetujui impor dan importir produsen gula kristal merah untuk diolah menjadi gula kristal putih ke 10 perusahaan swasta yang bergerak di bidang gula, padahal saat itu Indonesia mengalami surplus gula.
Kemudian Jaksa mengatakan saat itu Tom Lembong tidak menunjuk BUMN untuk menstabilisasi harga gula di Indonesia, malah menunjuk Induk Koperasi Kartika (INKOPKAR), Induk Koperasi Kepolisian Negara Republik Indonesia (INKOPPOL), Pusat Koperasi Kepolisian Republik Indonesia (PUSKOPOL), Satuan Koperasi Kesejahteraan Pegawai (SKKP) TNI Polri.
Tom Lembong menugaskan PT Perusahaan Perdagangan Indonesia (Persero) (PT PPI) untuk melakukan pengadaan gula kristal putih, lalu PT PPI bekerja sama dengan 10 perusahaan swasta untuk mengolah gula kristal merah menjadi kristal putih, padahal delapan perusahaan itu hanya memiliki izin pengelolaan gula rafinasi.
Jaksa menyebutkan, Tom Lembong tidak melakukan pengendalian distribusi dalam stabilisasi harga gula. Kata jaksa, seharusnya hanya BUMN yang bisa mengimpor gula.
Akibat perbuatannya, dia didakwa telah melanggar Pasal 2 ayat (1) atau Pasal 3 juncto Pasal 18 UU Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 55 ayat (1) ke-1 KUHP.
