Hal ini disampaikannya saat memberikan keterangan sebagai ahli dalam sidang lanjutan pengujian formil UU TNI di Mahkamah Konstitusi, hari ini, Selasa (1/7/2025).
Bivitri menjelaskan, dalam pengujian formil, partisipasi publik menjadi elemen penting. Hal itu lantaran berdasarkan putusan-putusan MK sendiri, partisipasi yang bermakna harus melibatkan semua pihak yang memiliki kepedulian atau bisa terdampak oleh suatu undang-undang tanpa memandang latar belakang profesinya.
Hal ini berbeda dengan MK yang justru beberapa kali tidak menerima permohonan uji materi UU TNI karena pemohon dianggap tidak memiliki legal standing atau kedudukan hukum.
