Terkait hal itu Badan Perlindungan Konsumen Nasional (BPKN) menyebut ada tiga mekanisme jika masyarakat merasa dirugikan dan akan menggugat Pertamina
Menurut Ketua BPKN Mufti Mubarok, setiap konsumen yang dirugikan bisa menggugat pelaku usaha.
Yakni, melalui peradilan khusus Badan Penyelesaian Sengketa Konsumen (BPSK).
Selain itu, melalui peradilan umum di pengadilan negeri.
“Berdasarkan Undang-Undang Perlindungan Konsumen (UUPK), setiap konsumen yang dirugikan dapat menggugat pelaku usaha melalui lembaga yang bertugas menyelesaikan sengketa antara konsumen dan pelaku usaha atau melalui peradilan yang berada di lingkungan peradilan umum,” ujar Ketua BPKN Mufti Mubarok, saat dihubungi Kompas.com, Kamis (27/2/2025).
Dalam Pasal 46 Ayat (1) dijelaskan, gugatan bisa dilakukan oleh konsumen yang dirugikan atau ahli waris yang bersangkutan.
Kemudian, sekelompok konsumen yang mempunyai kepentingan yang sama.
Lalu, lembaga perlindungan konsumen swadaya masyarakat yang memenuhi syarat, berbentuk badan hukum atau yayasan.
Dalam anggaran dasarnya menyebutkan dengan tegas tujuan didirikannya organisasi tersebut adalah untuk kepentingan perlindungan konsumen dan telah melaksanakan kegiatan sesuai dengan anggaran dasarnya.
